Domestic Violence Discrimination

Too often, victims of domestic violence suffer difficulties at work as a result of their abuse. Employers are sometimes frightened of having a worker who is associated with someone who is obviously violent and unpredictable. In other situations they do not like the public image a worker with visible bruises portrays to customers. Some victims who want to take leave for things like court appearances related to their situation find that they are given a hard time whereas other employees are allowed to take leave for other reasons.

Although status as a victim of domestic violence is not a ground of a discrimination claim in and of itself in most jurisdictions, sometimes there are ways to make employment claims for these kinds of situations. For example, where there is proof that a woman in the workplace was fired for having a bruised face from her husband but a man who had been in a bar fight over the weekend was not, there might be a claim for discrimination.

At TW&A we are one of only a few firms nation-wide which has specific experience in this area of the law. We can help determine whether you might have a claim against your employer and if so, vigorously pursue any such claims on your behalf.
