Alimony and Spousal Support Issues

In Georgia, alimony, also referred to as spousal support or spousal maintenance, is determined on a case-by-case basis. The courts will consider a number of factors when deciding whether to award alimony. Some of these factors are:

  1. the respective incomes of each spouse;
  2. the age of each spouse in relation to the length of the marriage; and
  3. the ability of each spouse to earn a living.

Whether you are seeking spousal support, you are defending against a claim for such support, or you disagree with the amount of spousal support being demanded of you, we will work to help you achieve your goals.

Qualified Domestic Relations Orders ("QDRO's")

When either or both parties to a marriage have pension plans, 401k retirement savings accounts, or some form of IRA – equitable division of property in a divorce can include these funds.  These types of transactions require a specialized order – a “qualified domestic relations order” (referred to as a “QDRO”) – so that the transfer of these funds meets the requirements of the administrator of the retirement account.  At TW&A we have the necessary experience to assist you in advising you of your rights and in drafting these specialized orders. 

Property Division

Divorce also involves “equitable division” of property, both real and personal.  “Equitable” division does not mean “equal” and just as in alimony and spousal support issues, the courts consider a number of factors in determining what an “equitable” division of property.  The factors include:

  1. Real Property
    • The current market value of the property;
    • When the property was acquired (before or during the marriage);
    • The contribution of each spouse toward the property and the source of those funds;
    • The need of either party to stay in the marital residence for the benefit of children.
  2. Personal Property
    • Comparable value in vehicles owned/needs of each spouse for work or child transportation purposes;
    • Total value of furnishings in the residence, when/how acquired;
